End User License Agreement (EULA)

Effective Date: April 28, 2026

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User" or "you") and ForeverTale ("we," "our," or "us") for the use of the ForeverTale mobile application (the "App" or "Licensed Application"). By downloading, installing, or using the App, you agree to be bound by this Agreement.

This Agreement is between you and ForeverTale only, and not with Apple Inc. ("Apple"). ForeverTale, not Apple, is solely responsible for the Licensed Application and its content.

1. License Grant

ForeverTale grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

3. Eligibility

You must be at least 18 years old to create a ForeverTale account. The App is designed for use by families, and adult account holders are responsible for any use of the App by minors under their supervision.

4. Account Registration

To use certain features of the App, you must create an account by providing a valid email address, your name, and a password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

5. Subscriptions and Payments

Free Tier: ForeverTale offers a free tier that includes up to 5 stories and core recording functionality.

Premium Subscription: ForeverTale Premium is available as an auto-renewable monthly subscription at $4.99/month. Premium unlocks unlimited stories, family connections, and story sharing.

Subscription Details:

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time in your Apple ID account settings (Settings → Apple ID → Subscriptions). Refunds are handled by Apple according to their refund policies.

6. User Content

You retain all ownership rights to the stories, recordings, and other content you create using the App ("User Content"). By using the sharing features of the App, you grant ForeverTale a limited, temporary license to transmit your shared content to your designated recipients. This license expires when the content is delivered or automatically deleted (within 24 hours), whichever comes first.

You are solely responsible for your User Content. You agree not to create, upload, or share content that:

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Maintenance and Support

ForeverTale is solely responsible for providing maintenance and support services for the App, as described in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

9. Warranty

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be ForeverTale's sole responsibility.

10. Intellectual Property

The App, including its design, features, code, graphics, and branding (excluding User Content), is owned by ForeverTale and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ForeverTale, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

11. Account Deletion

You may delete your account at any time through the App's settings. Account deletion is permanent and will remove your account data from our servers. Stories stored locally on your device or in your iCloud account are not affected by account deletion and must be managed separately.

12. Termination

We reserve the right to suspend or terminate your account if you violate this Agreement or engage in conduct that we determine, in our sole discretion, to be harmful to other users or to ForeverTale. Upon termination, your right to use the App will immediately cease. You may also terminate this Agreement by deleting the App and your account.

13. Limitation of Liability

To the fullest extent permitted by applicable law, ForeverTale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of content, or loss of profits, arising out of or related to your use of the App.

14. Indemnification

You agree to indemnify and hold harmless ForeverTale, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App or violation of this Agreement.

15. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

16. Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Changes to This Agreement

We may update this Agreement from time to time. When we make changes, we will update the "Effective Date" at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Agreement.

18. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
